The Allendale Bar & Grill and The Mahwah Bar & Grill (“Company”, “we”, “us” or “our”) care about the protection of your personal information. This Privacy Policy (“Privacy Policy”) is our policy regarding our treatment of two types of information we collect from or about you (“Information”) in connection with your use of the www.allendalebarandgrill.com and www.mahwahbarandgrill.com websites and any other websites at which this Privacy Policy is posted (collectively, the “Site”): 1) personal information that identifies you (“Personal Information”), like your name, e-mail address, payment card information and other transaction information or phone number, as well as other non-public information you may provide to us, and 2) information we collect automatically, such as technical, tracking and other anonymous data (“Anonymous Information”).

We may receive information about you from third parties. For example, if you make a reservation at one of our restaurants through our partner site and opt to receive communications from us via the partner site, then we will receive Personal Information about you from our partner site. Our use of such information will be subject to this Privacy Policy and our partner site’s use of such information will be subject to our partner site’s Privacy Policy.
How We Share Your Personal Information
We will not disclose, sell, trade or otherwise transfer any Personal Information to third parties, except (i) to parties who perform services for us; (ii) when we believe that such disclosure is required by law and/or to comply with a judicial proceeding, court order, or legal process (including but not limited to subpoenas and investigations); (iii) to enforce the Privacy Policy; (iv) to protect the rights, property, security or safety of the Company, Site users or the public; (v) to respond to an emergency; or (vi) as otherwise stated in this Privacy Policy or authorized by you. The www.allendalebarandgrill.com and www.mahwahbarandgrill.com websites (collectively, the “Site”). Use of the Site is available only on the terms and conditions described in these Terms of Use (“Terms of Use”). BY USING THE SITE YOU AGREE TO BE BOUND BY THE TERMS OF USE. Governing Law; Arbitration; Time Limitation for Claims
The Terms of Use shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflicts of law provisions. Any dispute, controversy, or claim arising out of, relating to, or concerning the Site or the Terms of Use (“Claim”) shall be submitted to final and binding arbitration administered by the American Arbitration Association (“AAA”) before a single, neutral arbitrator, under its Commercial Arbitration Rules then in effect and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. Any such arbitration will be conducted in New York, New York. All arbitration awards shall be limited to monetary damages; provided that the arbitrator shall not have authority to award punitive damages. To the maximum extent permitted by law, you permanently and irrevocably waive the right to bring any Claim in any forum unless you provide Company with written notice of the event or facts giving rise to the Claim within one (1) year of their occurrence.
Miscellaneous
If any provision(s) of the Terms of Use is held by a court of competent jurisdiction to be unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. The Company’s failure to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by the Company in writing.
